According to 18 Penn. Cons. Stat. § 2701, simple assault is a second degree misdemeanor. However, these charges can be upgraded or downgraded if the offense occurred under certain circumstances.
In West Chester, if simple assault occurred during a fight or scuffle that both parties engaged in by mutual consent, this offense is considered a third degree misdemeanor. If simple assault is committed by an offender who is over 21 and the victim is less than 12 years old, this offense can be charged as a first degree misdemeanor.
