Charges for Careless and Reckless Driving

Careless Driving in Pennsylvania

Under 75 Pa. Cons. Stat. § 3714, an individual is guilty of careless driving if he or she drives a vehicle in careless disregard for the safety of other people or property.

In most cases, careless driving is considered a summary offense, which is punishable by up to a 90-day jail sentence and/or a fine of up to $300. However, the penalties associated with this offense can be enhanced under certain circumstances.

For instance, if the careless driving caused serious bodily injury to an individual, a $250 fine becomes mandatory, along with the potential jail time associated with a summary offense. If the careless driving resulted in the unintentional death of another person, the mandatory fine goes up to $500.

Reckless Driving in Pennsylvania

According to 75 Pa. Cons. Stat. § 3736, anyone who drives a vehicle in willful disregard for the safety of other people or property, is guilty of reckless driving. This is a summary offense, and it is punishable by a $200 fine.

In order for an individual to be convicted of reckless driving, the prosecution must prove that he or she knowingly, purposely, or intentionally disregarded the safety of people or property while driving.

This can sometimes be difficult to prove because the prosecution cannot always clearly show what the defendant’s intentions were. An experienced traffic defense attorney may be able to successfully argue that the defendant did not intentionally disregard the safety of others, which could lead to charges being dismissed or reduced.
