Common Illegal Prescription Drugs in Pennsylvania

The use of certain drugs is regulated or banned through the Federal Controlled Substances Act and the Pennsylvania Controlled Substances, Drugs, Device, and Cosmetic Act. These laws also outlines the specific guidelines for receiving a legal prescription through a licensed physician.
Some of the more common substances that are addressed include:

  • Diazepam, or Valium
  • Oxymorphone, or Oxycontin
  • Oxycodone, or Percocet
  • Hydrocodone, or Vicodin
  • Alprazolam, or Xanax
  • Meperidine, or Demerol
  • Amphetamines, such as Adderall

Even if an individual has legally obtained a prescription, there are still certain rules regulating the use of such drugs. For instance, a person may not operate a vehicle while influenced by their medication.


Prescription Drug Offenses and their Penalties

Although simply possessing a drug without a prescription may seem like a minor offense, it still carries heavy consequences. The offense is considered a misdemeanor, which can be penalized by up to a year in jail and a fine of up to $5,000.

Anyone who distributes a drug to a person without a legal prescription may be charged with possession with intent to distribute (PWID). A pharmacist may even face this charge if they neglect their duty to ensure that a person has a valid prescription. The penalties for this offense vary depending on the drug in question, ranging from a misdemeanor to a felony.

For schedule V drugs, a charge of PWID carries the possibility of up to a year in jail and a fine up to $5,000. For a schedule IV drug, a conviction carries up to 3 years in prison and up to $10,000 in fines. Schedules I, II, and III may be punished by up to 5 years in prison and up to $15,000 in fines.

Pennsylvania law also outlines in 35 Penn. Cons. Stat. § 780-113(a)(12) that a person may not obtain a drug through falsifying information, fraud, or other misrepresentation. This includes any effort to fake a prescription, either when filing it with a pharmacy or when retrieving the medication.
