Penalties for Drug Trafficking in Pennsylvania

18 Pa. Cons. Stat. 7508 outlines the potential sentencing for all drug trafficking offenses. These penalties vary greatly depending on the drug in question, the amount, and the offender's prior record. The following is simply a general guideline for penalties for trafficking Schedule I and II drugs, although certain drugs, such as heroin, cocaine, and methamphetamines have consequences that are defined separately:

  • 2-10 grams: this may be penalized by up to 2 years in jail and a fine of up to $5,000.
  • 10-100 grams: This offense carries a possibility of up to 3 years in prison and up to $15,000 in fines.
  • 100 grams or more: this carries the possibility of up to 5 years in prison and up to $25,000 in fines.
